Terms of Service
Effective: May 4, 2026
These Terms of Service (“Terms”) govern your access to and use of the CoastalOps platform (the “Service”), provided by CoastalOps (“we”, “us”). By creating an account or using the Service, you agree to be bound by these Terms.
1. The Service
CoastalOps is a software-as-a-service platform that helps field service businesses (e.g. pool, spa, HVAC, landscape companies) build routes, dispatch technicians, capture proof of service, and bill customers. The Service is delivered via web and mobile (PWA) access at your tenant URL.
2. Accounts
You must register an account to use the Service. You are responsible for safeguarding your credentials and for all activity under your account. You agree to provide accurate information and to keep it current.
3. Subscription & Billing
- Access to the Service requires a paid subscription on one of our published plans (Founding Partner, Starter, Growth, Scale, or Enterprise).
- Subscriptions are billed monthly in advance via Stripe. By subscribing you authorize us (via Stripe) to charge your designated payment method on a recurring basis.
- Subscriptions auto-renew until canceled. You may cancel at any time via the customer billing portal; cancellation takes effect at the end of the current billing period.
- Plan upgrades take effect immediately and are pro-rated. Downgrades take effect at the start of the next billing period.
- Fees are non-refundable except where required by law. If you believe you were charged in error, contact us within 14 days of the charge.
4. Acceptable Use
You agree not to:
- Use the Service to violate any law, infringe any right, or transmit malware or unlawful content.
- Attempt to access another customer's data, reverse engineer the Service, or circumvent security features.
- Resell, sublicense, or use the Service to build a competing product.
- Send unsolicited communications via the Service's integrations (SMS, email).
5. Customer Data
You retain all rights to data you submit (“Customer Data”), including service records, photos, customer contact information, and billing records. You grant us a limited license to host, process, and display your Customer Data solely to provide and improve the Service. Our handling of Customer Data is governed by our Privacy Policy.
On termination, you may export your Customer Data within 30 days. We may delete your data after that window.
6. Service Availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party provider outages (Supabase, Vercel, Stripe, Resend, Twilio, Anthropic), and force majeure events may cause downtime.
7. Third-Party Services
The Service integrates with third parties including Stripe (billing), Supabase (data + auth), Vercel (hosting), Resend (email), Twilio (SMS), Anthropic (AI features), and QuickBooks Online (optional accounting sync). Use of those services is also governed by their own terms and privacy policies.
8. Confidentiality
Each party agrees to protect the other's confidential information with reasonable care and not to use or disclose it except as permitted under these Terms.
9. Disclaimers
The Service is provided “as is” and “as available”. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability under these Terms is limited to the amount you paid us in the 12 months preceding the claim. Neither party is liable for indirect, special, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold us harmless from any third-party claim arising out of your Customer Data or your breach of these Terms.
12. Termination
Either party may terminate the Service at any time. We may suspend or terminate your account immediately if you breach these Terms or fail to pay. Upon termination, your right to use the Service ends; the following sections survive: 5 (Customer Data export), 8 (Confidentiality), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), 14 (Governing Law).
13. Changes
We may update these Terms from time to time. Material changes will be posted here and emailed at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws provisions.
